
Terms and Conditions for Auction of Personal Property
- All persons wishing to bid at today's auction shall first receive and read the terms and conditions form provided herein, then register and give full identification prior to the beginning of the auction. Bidder-purchaser is required to display the number issued them when identifying themselves as the successful bidder. Bidder may be video recorded at registration.
- Purchases are strictly cash, certified funds, guaranteed "good" personal check approved by the auctioneer prior to the sale. Credit cards accepted (MC, VISA) with additional 3% handling charge. There will be a $25.00 service charge for any returned checks for any reason! No Exceptions!
- The order of items sold shall be determined at the sole discretion of the auctioneer and his staff. No requests from the audience will be honored. Please do not ask.
- The preview area will close at the beginning of the auction. Previews are normally 2 hours preceding each auction.
- 4.5% sales tax will be charged at today's auction.
- If the auctioneer determines that any bid is not commensurate with the value of the article offered, he may reject the same and withdraw the item from the auction.
- The auctioneer may reject any advance bid he determines to be insufficient. In the event of an absentee bid or phone bid, the auctioneer will carry the bid from the block, and a tie bid will be awarded the live bidder.
- The auctioneer reserves the right to bid on behalf of the seller when lots held in reserve are offered equal to but not exceeding the minimum reserve. The reserve item and reserve price may or may not be revealed.
- Ownership title passes upon the fall of the auctioneer's gavel or other customary manner and thereafter the property is at the risk of the buyer and neither the seller nor auctioneer shall be responsible for loss or damage.
- Every item is sold "as is." Neither the auctioneer or the seller make any warranties or representations of any type or nature with respect to said property. It is the responsibility of the prospective purchaser to inspect the property and use their judgment to assess a value for such property as conditions warrant.
- All sales are final! No returns and no refunds! No Exceptions! This auction may be video recorded.
- A 13% buyer's surcharge with 3% discount for cash and checks will be added to and become a part of all final bid prices.
- All purchases shall be Paid In Full by the close of the auction and no items shall be removed without first presenting paid receipts to auctioneer's security personnel.
- All items must be removed from auction site the day of the sale unless prior arrangements have been made with the auctioneer. Items left for pick up on the site are left at the purchaser's risk and seller nor auctioneer shall be responsible in any manner for these items. Items not picked up the day of the sale shall revert to seller's ownership, unless prior arrangements have been made with the auctioneer to pick up items at a later date.
- Purchasers are totally responsible for all costs incurred with removal of their purchases and any and all damages or personal injury incurred during removal shall rest upon the purchaser.
- In the event of a tie/disputed bid, the property shall be resold; but, the auctioneer shall use his judgment as to good faith of all claims and the auctioneer's decision shall be final.
- In the event a dispute should arise concerning any matter of the sale of an item or items at settlement, the auctioneer's records shall be conclusive in all respect.
- Title to all property sold shall not transfer, if paid with personal or company check, until such check has cleared the auctioneer's escrow account. Seller shall hold title ownership until such check has been paid to the auctioneer's escrow by the bank upon which it is drawn. Any check issued by the purchaser payable to the auctioneer which is found to be bogus for any reason shall be subject to the maximum service charge allowable under law. Furthermore, any and all costs incurred by the auctioneer for collection of funds shall be paid by the purchaser including but not limited to legal fees, court costs, filing charges, phone, fax, etc.
- This is a privately-owned auction firm and we reserve the right to refuse admittance to any person or persons and to demand that any person or persons leave the auction site at our discretion.
- The auctioneer reserves the right to withdraw any property prior to or during the auction.
- The bidder hereby agrees to indemnify to hold harmless the auctioneer, his staff, and seller from any and all damages, claims or liabilities from injury to persons or property of any type whatsoever caused while the bidder is present at the auction site.
- Any controversy or claim arising from or relating to this contract, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association under its rules and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
- The bidder, by actions of registering at today's auction and receiving a bid card, hereby agrees to accept and abide by the above terms and conditions of today's auction. Any and all persons attending today's auction by invitation of the bidder shall be considered the bidder's agent and shall be subject to all above listed terms. Registered bidders are responsible for the actions of their guests.
